The petitioner is in custody in connection with Kartaha P.S. Case No. 85 of 2018 for the offences under Sections 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 15.12.2018. He further submits that the name of the petitioner surfaced only on suspicion and nothing was recovered from the possession of the petitioner. He further submits that the delay of four days in lodging F.I.R.

Considering the fact that petitioner has no criminal antecedent and delay of four days in lodging F.I.R. and petitioner has remained in custody for more than three months,
