JUSTICE RAKESH KUMAR ORAL ORDER 07-09-2015 Heard Sri Shivendra Prasad, learned counsel for the petitioner and Sri Rajendra Prasad, learned counsel, who has appeared on behalf of the respondents.
The petitioner, has approached this court under Article 226 of the Constitution Of India, against a letter no. 501 dated 1.4.2015, whereby, he has been asked to pay the due amount and also directed to get licence under Rule 26A of the Bihar Minor Mineral Concession Rule 1972. In the writ petition in paragraph no. 10 it has been stated that after receipt of notice he met with the Assistant Director, District Mining Officer, Gaya, and requested not to take any action, but no heed has been paid by the authority concerned.
In the writ petition save and except notice dated
Patna High Court CWJC No.13115 of 2015 (3) dt.07-09-2015 2/2 1.4.2015 whereby it has directed to deposit the amount, nothing has been brought on record.
In view of the facts and circumstances, since by Annexure - "1", he has been noticed, if he feels aggrieved, he can file appropriate application / objection before the authority concerned demanding justice. The writ jurisdiction may not be invoked directly.
The writ petition stands dismissed.
