Lal, learned counsel for the petitioner and Mr. Raj Kishore Singh, learned counsel for the State. Petitioner seeks regular bail in connection with Rampur PS Case No. 02 of 2021 registered under Section 302 of the IPC.

As per the prosecution story a dead body was found by the Police behind the Police Line and during course of enquiry the dead body was identified that of one Ravikant Kumar, S/o Basant Prasad.

Learned counsel for the petitioner submits that the FIR is against unknown, however, during the course of

No.31886 of 2021(4) dt.31-03-2022 2/3 investigation one Sandip Kumar @ Soni, was arrested by the Police, who disclosed his involvement in the offence and said that he was having some grudge with the deceased and he along with the petitioner killed the deceased by assaulting him through a stone. Learned counsel further submits that Police during the investigation has also seized the mobile phone of the co-accused / Sandip Kumar @ Soni and the deceased and the location of Sandip Kumar @ Soni and deceased was found near the same.

On the other hand, Mr. Raj Kishore Singh, learned counsel for the State submits that after arrest of the petitioner and the co-accused, they admitted their involvement in the present offence, their confessional statement was recorded and on the basis of their confessional statement stone having blood mark was recovered from the place disclosed by the petitioner and the co-accused.

Regard being had to the submissions made by the parties, taking into consideration the fact that on the basis of confessional statement the stone / weapon of crime has been recovered by the Police having blood stain mark and multiple injuries have been found during the course of post mortem examination, I am not inclined to grant regular bail to the

Patna High Court CR. MISC. No.31886 of 2021(4) dt.31-03-2022 3/3 petitioner.

Accordingly, the prayer for grant of bail is rejected. However, the court below is directed to expedite the trial.
