JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Khagaria (Gangaur) P.S. Case No. 192 of 2018, registered for the offences punishable under Sections 366, 376, 380 and 120B of the Indian Penal Code.

Allegation as per complaint petition is of kidnapping of his wife by the petitioner and also having physical relationship with her.

Submission of learned counsel for the petitioner is that the present case has been filed in order to save his skin from Complaint Case No. 740(C) of 2018 lodged by one Gaurav Singh @ Chhotu Singh, son of Amrendra Singh, against the complainant and his family members in which the complainant has been made accused (Annexure-2) and further the complainant has filed a divorce petition in which he wants

Patna High Court CR. MISC. No.22320 of 2019(2) dt.08-04-2019 2/2 divorce from his wife as she has having sexual relationship with another person (Annexure-4).

Having heard both sides and in the facts and circumstances, as stated above, let petitioner, above named, surrender within a period of six weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Gangaur) P.S.Case No. 192 of 2018, G.R.No. 837 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
