25-10-2016 Heard Sri Ashok Kumar Jha, learned counsel, who was assisted by Dr. Bidhu Ranjan, learned counsel for petitioners and Sri Ram Sevak Choudhary, learned Addl. Public Prosecutor. Two petitioners, who were conductor and driver respectively, have made a prayer for grant of bail in Dagarua P.S. Case No. 76 of 2016 registered for offence under Section 273 of the Indian Penal Code and Section 47 (A) of the Bihar Excise (Amendment) Act, 2016.
By way of referring to statement made in paragraph - 3 of the petition, it was submitted by learned counsel for the petitioners that petitioners are having clean antecedent and on accusation of recovery of about 15 litres of Indian-make foreign liquor from dickey of a bus, petitioners were arrested.
Patna High Court Cr.Misc. No.46214 of 2016 (2) dt.25-10-2016 2/2 Learned Addl. Public Prosecutor has opposed the prayer for bail.
However, keeping in view nature of accusation, period of custody and clean antecedent of petitioners, let both the petitioners namely Triloki Singh and Akhilesh Jha @ Akhlesh Jha be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - II, Purnea in connection with Dagarua P.S.
