The petitioners seek bail in a case instituted under Sections 304(B), 315 and 120(B) of the Indian Penal Code. The allegation against the petitioners is that they along with their son have committed murder of the daughter of the informant due to non-fulfillment of the demand of dowry. It has been submitted on behalf of the petitioners that the petitioner no.1 is in custody since 26.05.2016 and the petitioner no.2 is in custody since 24.05.2016. The charge sheet has been submitted in the present case. The petitioners have got no criminal antecedent. There is no allegation of tampering of

Patna High Court Cr.Misc. No.44322 of 2016 (2) dt.17-10-2016 2/2 witnesses alleged against the petitioners. The petitioner no.1 is mother-in-law of the deceased and the petitioner no.2 is of the father-in-law of the deceased. They are separate in mess and property from the husband of the deceased. The husband of the deceased is in custody.

On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai, in connection with Lakhisarai (Kabaiya) P.S. Case No. 254 of 2016.
