The petitioner apprehends his arrest in connection with Runni Saidpur P.S. Case no. 236 of 2016, registered under Sections 366/34 of the Indian Penal Code.

The allegation of informant Shankar Jha is that on 29.02.2016, in the evening, his wife Puja Devi moved from his house for call of nature, but she did not return. On the next morning, in course of search, he came to know from Bechu Thakur and Jagail Thakur that Puja Devi had stayed at their house and in the next morning she moved after boarding on bus from Muzaffarpur to Kanpur. Later on, in course of search on 04.06.2016, the informant came to know that the petitioner with the help of his father Surendra Mishra, brother Navin Mishra and Arvind Mishra have kidnapped his wife and kept her in his house.

No.17020 of 2017 (2) dt.15-05-2017 2/2 Learned counsel for the petitioner submits that it would appear from the F.I.R. that occurrence of moving of wife of the informant took place in the evening of 29.02.2016 and after three months five days, informant came to know from rumour that his wife was kidnapped by this petitioner. Further submission is that petitioner has been implicated in this case only on suspicion and there is nothing against the petitioner to show his involvement in the present case. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in connection with Runni Saidpur P.S. Case No. 236 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
