JUSTICE PURNENDU SINGH ORAL ORDER 13-08-2025 Heard Mr. Shailesh Kumar Singh, learned counsel appearing on behalf of the petitioner; Mr. Prem Kumar Jha, learned APP for the State and Mr. Shakib Ayaz, learned counsel for the informant.
2. The petitioner seeks pre-arrest bail in connection with Aurangabad Mahila P.S. Case No. 53 of 2024 registered for the offence punishable under Sections 126(2), 115(2), 85 and 3(5) of the B.N.S. and Section 3⁄4 of the Dowry Prohibition Act.
3. Allegation is of torturing the informant due to nonfulfillment of demand of dowry.
4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner is innocent and he has
Patna High Court CR. MISC. No.24970 of 2025(3) dt.13-08-2025 2/3 falsely been implicated in the case. He further submitted that the petitioner in Paragraph No.10 of the bail application has stated that he is ready to keep his wife with full love and dignity.
5. Learned counsel appearing on behalf of the informant submitted that the opposite party no.2 is also ready to live along with the petitioner.

Considering the desire of the opposite party no.2 that she is ready to live along with the petitioner and petitioner has given information in Para-10 of the bail application that he is ready to keep his wife with full love and dignity, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Aurangabad, Bihar in connection with Mahila P.S. Case No. 53 of 2024, subject to the condition as laid down under Section 438(2) Cr.P.C / 482(2) BNSS.
7. The District Court is directed to verify the criminal antecedent of the petitioner and if it is found that the petitioner is involved in some other cases as what has been stated in Para3 of the bail petition, this order will automatically lose its force.
