JUSTICE RAMESH KUMAR DATTA ORAL ORDER 05-08-2015 A show cause is filed on behalf of the opposite party no. 2 in which the circumstances of his non-appearance in Court on the previous date have been mentioned. Opposite party No. 2 is also personally present. Let the same be kept on the record.

It is submitted by learned counsel for the opposite party no. 2 that all steps have now been taken to pay the death-cum-retiral dues of the deceased employee and the payment shall be made within a week from today in the Bank Account of the petitioner which has been supplied by learned counsel for the petitioner to him today.

With regard to pension, it is submitted by learned counsel for the Nagar Parishad, Chhapra that the

Patna High Court MJC No.4369 of 2014 (6) dt.05-08-2015 2/2 petitioner has not yet filed the pension paper in the prescribed form and the moment the same is filed by the petitioner it shall ensure that the pension is also sanctioned.

Learned counsel for the petitioner submits that the petitioner would be filing the pension form within two weeks from today.

In view of the aforesaid facts which are also stated in the show cause filed earlier on behalf of the opposite party no.2, learned counsel for the petitioner submits that he is satisfied that the order under contempt has been substantially complied with by the opposite parties, subject to the undertaking given by them with regard to payment of pension. On a consideration of the aforesaid facts and circumstances and the show cause filed on behalf of the opposite parties, the contempt proceedings are dropped. (Ramesh Kumar Datta, J) S.Pandey/- U
