It is contended on behalf of the petitioner that he had applied for arms licence in the year 2013 itself, however, his application was rejected on 11,12,2013 against which he preferred Arms Appeal No. 21/2014. The Divisional Commissioner, Munger after setting aside the order passed by the licensing authority, had remitted the matter back to the licensing authority for fresh consideration. Thereafter, even though a fresh report was sought from the Superintendent of Police, Sheikhpura, who had recommended for grant of arms licence to the petitioner vide Annexure 2, no decision is being taken by the licensing authority. Having regard to the facts and circumstances, this writ application is being disposed of with a direction to the District
Patna High Court CWJC No.13998 of 2015 (2) dt.15-09-2015 Magistrate-cum-Licensing Authority, Sheikhpura to take a decision in the matter in respect of grant of arms licence to the petitioner in accordance with law and also in terms of the appellate order considering the report of the Superintendent of Police, Sheikhpura, within a period of three months from the date of receipt /production of a copy of this order.
