The petitioners apprehend their arrest in a case registered for the offence under Section 302/34 of the Indian Penal Code.

As per prosecution case, all the F.I.R. named accused persons including these petitioners assaulted the sister of informant, as a result of which, she died during course of treatment. Petitioner no. 1 is brother-in-law and petitioner no. 2 is father-in-law of the deceased.

It is submitted on behalf of petitioners that petitioners are separate in mess & property and have got no concern with the affairs of deceased and her husband. As a matter of fact, due to petty dispute between the husband and the deceased, the

Patna High Court CR. MISC. No.21695 of 2022(8) dt.13-12-2022 2/2 deceased committed suicide. Doctor has not found any external injury on the person of deceased. Thrust of the accusation is against husband of the deceased, who is already in custody. This fact has been stated in paragraph 2 of the supplementary affidavit.

Learned A.P.P. has opposed the prayer for bail. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M. Motihari in connection with Chakiya P.S. Case No. 403 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
