The petitioner is apprehending his arrest in connection with Kotwali (Barari) P.S. Case No. 4 of 2017 registered for the offences punishable under Sections 498A of the Indian Penal Code and 3/4 of Dowry Prohibition Act.
Petitioners are mother-in-law and father-in-law of the informant.
It has been submitted on behalf of the petitioners that the allegation, made in the FIR that her mother-in-law has given intoxicant to her husband and tried to make him mentally ill, is absurd and, as a matter of fact, the informant is not ready to live either with her husband or the petitioners and, as such, the present false and concocted case has been filed for blackmailing them.

Having heard both sides and considering the facts and circumstances of the case, let the petitioners, named above, in the event of their arrest or surrender in the court within a period of two weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Barari) P.S. Case No.4 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that petitioners shall co-operate in the investigation and make themselves available before the police as and when required and in the event of failure on their part to appear before the police on two consecutive dates, the prosecution shall be free to move for cancellation of their bail bonds and further petitioners will not induce any witness or tamper with the evidence.
