2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 147, 149, 342, 323, 307, 353, 379, 504 of the Indian Penal Code and Section 25(1AB) of Arms Act.
3. According to F.I.R., this petitioner along with other accused persons on the alleged date and time of the occurrence, assaulted the informant and tried to snatch his service pistol.
4. Learned counsel for the petitioner denies the prosecution case and submits that as a matter of fact, on the alleged date and time of the occurrence, marriage ceremony of sister of the petitioner was being performed on first floor of the same hotel where the informant became unconscious due to excessive consumption of alcohol and the matter was reported
Patna High Court CR. MISC. No.24280 of 2024(2) dt.08-05-2024 2/2 to the police who came there and took the informant to the hospital. The petitioner only reported the occurrence to the higher police officials due to which he has falsely been implicated in this case. He lastly submits that even as per the injury report the informant has not sustained any noticeable injury. Rest of the allegations are ornamental in nature only to make the case grave.

Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bikramganj, Rohtas in connection with Bikramganj P. S. Case No. 620 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
