Both these cases have been filed for modification in the order of this Court dated 17.08.2015 passed jointly in Cr. Misc. No. 18074 of 2014 and Cr. Misc. No. 20951 of 2015. Learned counsel for the petitioners has explained that it was on account of typographical or oversight that in the prayer portion in Cr. Misc. No. 18074 of 2014 "Chief Judicial Magistrate, Kaimur at Bhabua" had been mentioned in place of "Chief Judicial Magistrate, Buxar"
Patna High Court Cr.Misc. No.42901 of 2015 (2) dt.15-09-2015 2/2 and to substantiate this aspect, he also points out to the correction made in the prayer portion of the other application i.e. Cr. Misc. No. 20951 of 2015 wherein on being pointed out the defect by stamp reporter, the correction of "Chief Judicial Magistrate, Kaimur at Bhabua" was made substituting "Chief Judicial Magistrate, Buxar".
That being so, this Court would modify the earlier order of this Court dated 17.08.2015 passed jointly in Cr. Misc. No. 18074 of 2014 and Cr. Misc. No. 20951 of 2015 by substituting the " Chief Judicial Magistrate, Buxar" in place of Chief Judicial Magistrate, Kaimur at Bhabua and also extend the time for surrendering of the petitioners by further period of four weeks.
Let the earlier order dated 17.08.2015 passed jointly in Cr. Misc. No. 18074 of 2014 and Cr. Misc. No. 20951 of 2015 and this modified order be sent to the court of learned Chief Judicial Magistrate, Buxar.
With the aforesaid modification in the order dated 17.08.2015 both these applications are disposed of. (Mihir Kumar Jha, J) Sujit/- U
