The petitioner apprehends his arrest in Begusarai Town P.S. Case No. 132/2016, registered for the offences punishable under Sections 379, 384 and other sections of the Indian Penal Code.
The informant alleged that the petitioner and others came in the petrol-pump and took petrol of Rs. 30/- from Anil Kumar staff of the petrol-pump, but thereafter, the petitioner and others demanded extortion and the petitioner snatched Rs. 9,500/-. Learned counsel for the petitioner submits that there was some altercation for exchange of Rs. 500/- between the petitioner and the informant. The petitioner has falsely been implicated in the case. The petitioner has got no criminal antecedent, but it appears that the informant and other witnesses
Patna High Court Cr.Misc. No.10468 of 2017 (3) dt.03-04-2017 2/2 have stated that the petitioner demanded extortion and snatched Rs. 9,500/- from the possession of the informant. Considering the facts aforesaid, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
If the petitioner surrenders in the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail, learned court below shall consider the prayer for regular bail of the petitioner taking into consideration that the petitioner has got no criminal antecedent.
