Petitioner seeks bail in kako P.S. Case No.98 of 2018 registered for the offence punishable under Sections 420, 467, 468, 471, 414 and 413 of the Indian Penal Code. Allegation against the petitioner is of sitting in stolen SAFARI vehicle and no ownership of said vehicle was produced by the occupants of SAFARI vehicle and all persons were arrested including the petitioner.

It has been submitted on behalf of the petitioner he is neither the driver nor the owner of the said vehicle and he has nothing to do with the alleged vehicle. It has further been submitted that similarly placed accused persons Manish Kumar @ Panditji and Satyendra Kumar have already been granted bail by co-ordinate Benches of this Court vide order dated

Patna High Court Cr.Misc. No.71427 of 2018(3) dt.12-12-2018 2/2 27.11.2018 passed in Cr. Misc. No.67818 of 2018 and order dated 03.12.2018 passed in Cr. Misc. No.69991 of 2018 respectively.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Jehanabad in connection with Kako P.S. Case No. 98 of 2018 with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.

(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court below.

(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
