JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 290 of the Indian Penal Code and Section 47(A) of Excise Act.

Taking into consideration that 160 litres country made liquor (raw sprit) and 20 litres toddy were recovered from the house of the petitioner, I am not inclined to release the petitioner on bail, at least, at this stage and hence, his prayer for bail in connection with Kesariya P.S. Case No. 124 of 2016 pending in the court of Chief Judicial Magistrate, Motihari, East Champaran stands rejected.

However, the trial court should expedite the trial of
