====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 26-11-2018 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Excise Case No. 1176 of 2018 arising out of Jagdishpur P.S. Case No. 278 of 2018 instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that informant on secret information reached in village Isarhi near vegetable market and saw that some persons were selling illegal wine on the bank of river. On seeing the police party, they managed to run away. It is further alleged that 52 liters of Mahua liquor has been recovered from the bank of river. The Chowkidar of the village disclosed the name of this petitioner along with two others.
Patna High Court Cr.Misc. No.67529 of 2018(2) dt.26-11-2018 2/2 Seizure list has been prepared which is part of the First Informant Report. From the seizure list it appears that there is no recovery from conscious possession of the petitioner.
Petitioner is said to be in custody since 11.9.2018. Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge Ivth cum Special Judge (Excise), Bhojpur at Ara, in connection Excise Case No. 1176 of 2018 arising out of Jagdishpur P.S. Case No. 278 of 2018 subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
