JUSTICE RAMESH KUMAR DATTA) 09-03-2015 When the matter was called out, a prayer for adjournment was made on behalf of learned counsel for the petitioners. But without such adjournment being granted by this Court, learned counsel for the petitioners hurriedly left the Court room. Earlier also on 27.02.2015, prayer for adjournment had been sought for by learned counsel for the petitioners to enable him to consider the show cause filed on behalf of the
Patna High Court MJC No.4582 of 2014 (6) dt.09-03-2015 2/2 opposite parties. However, till today, no reply to the show cause has been filed.
Direction of this Court by order dated 10.3.2014 was to the respondent-Railways to grant personal and representative hearing to the appellants in L.P.A., identifying and spelling out the materials and grounds on which the appellants may be sought to be distinguished and thereafter pass a reasoned and speaking order.
In the show cause filed on behalf of the Railways, it is stated that as per the direction of this Court, reasoned order has been passed on 21.11.2014 by the CE/Con/IV/E.Rly/KKK Eastern Railway, Kolkata and the request of the applicants for their engagement in Railways on land acquisition ground considering them similarly situated like the applicants of L.P.A. No.1850 of 2012 was held as not acceptable. In the aforesaid circumstances, we are of the view that no case for contempt is made out. The contempt application is, accordingly, dismissed.
