Petitioner, who is in custody, seeks bail in connection with Shahpur P.S. Case No. 116 of 2018 registered for the offences punishable under Sections 413, 420, 467, 468, 471 of the Indian Penal Code.

Informant who is police officer has stated that he got secret information that near NH 84 Ara-Buxar Road, six persons with stolen motorcycle assembled together and planning to commit crime. Informant with police party reached at the place, on seeing police party they tried to flee away but with the help of police four of them were caught and two persons succeeded to flee away.

It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.67031 of 2018(2) dt.26-11-2018 2/2 that he is innocent and has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Petitioner was not present at the alleged place of occurrence. The name of the petitioner has transpired on the basis of the statement of co-accused. Petitioner has no criminal antecedent and he is in custody since 26.06.2018. Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-14th , Bhojpur at Ara, in connection with Shahpur P.S.
