JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 419, 420, 467, 468, 471 of the Indian Penal Code and 15(2)B, 15(3) of I. M. C. Act. Allegation against the petitioner is that he is a forged doctor.
It has been submitted on behalf of the petitioner that he has got no criminal antecedent. The certificate of MBBS course has been annexed as Annexure-3 to the present application. The present case has been instituted only on the basis that since the petitioner was not there, hence it was presumed that he was practising without his requisite qualification. Other co-accused has been granted bail vide Cr. Misc. no. 31321 of 2014. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the
Patna High Court Cr.Misc. No.39666 of 2015 (2) dt.30-09-2015 2 / 2 court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan, in connection with Siwan Town P.S. Case no. 525 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) sudip/- U T
