JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-04-2015 Petitioner No.1 is father-in-law and petitioner No.2 is mother-in-law of the deceased and are accused in a case under sections 304(B)/34 of the IPC.
Learned counsel for the petitioners, referring to the first information report, has submitted that there is specific allegation of demand of motor cycle as dowry against the husband of deceased and there is no specific allegation against the petitioners. He has further submitted that petitioners are old and ailing persons and no tangible purpose would be served if the petitioners are taken into custody. He has further submitted that petitioners will co-operate with the investigating agency in all possible manner and there is no chance of their absconding from
Patna High Court Cr.Misc. No.48139 of 2014 (2) dt.30-04-2015 2/2 the course of trial.
In view of submissions, as above, the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Vaishali PS case No. 283 of 2014, subject to condition as laid down u/s 438(2) of the Code of Criminal Procedure.
