====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------- 06-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Rail Raxaul P.S. Case No.22 of 2014 registered under Section 363, 365, 364-A and 120B of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, one Ashwini Kumar alias Ashwini Dubey alias Golu was apprehended by the police, as detailed in paragraph-54 of the case diary, who confessed his guilt in the kidnapping of the victim, the husband of the informant, alongwith nine others including one Rajkumari Devi. Later on, the victim was recovered, as detailed in paragraph-107 of the case diary, who stated that he was taken by Sushil Singh to Nepal and, thereafter, he was set free by the accused persons after making payment

Patna High Court Cr.Misc. No.3410 of 2017 (3) dt.06-03-2017 2/2 of ransom. During the course of investigation, it has only come against the petitioner that he used to talk to Rajkumari Devi, whose name had also been disclosed by the apprehended co-accused Ashwini Kumar alias Ashwini Dubey alias Golu. Except that, there is nothing against the petitioner to show his involvement in the commission of the alleged offence. The petitioner is in custody since 06.08.2016. It is further submitted at the Bar that while the petitioner is accused in three other cases, as detailed in paragraph-3 of the case diary, but in all the cases, the petitioner is on bail.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Rail, West Champaran, Bettiah, in connection with Rail Raxaul P.S. Case No.22 of 2014. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
