Heard the parties in virtual Court.

Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 354(B), 447, 379, 307, 504, 506/34 IPC.

Both sides are agnates. There is case and counter case. General and omnibus allegation is there against the male and female members of the family of commission of assault. Investigation of the case is already complete. Petitioner has got no criminal antecedent.

Learned counsel for the informant opposed the prayer for bail on the ground that the petitioner bears allegation of

Patna High Court CR. MISC. No.33771 of 2021(2) dt.03-08-2021 2/2 commission of assault with iron rod on the vital part of the body. Considering the fact that the occurrence allegedly took place at the spur of moment and the petitioner has got no criminal antecedent, investigation of the case is already complete and there is no material to substantiate that the petitioner is going to tamper with the evidence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Fulwarai Police Station Case No.17 of 2021 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
