JUSTICE SUDHIR SINGH ORAL ORDER 30-04-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 658 of 2014 for the offence under Section 498A of the Indian Penal Code and Section 3 /4 of D.P.Act. Heard learned counsel for the petitioner and the State. The prosecution case, in brief, is that the complainant has alleged that she was married with the petitioner on 12.05.2013 and she went to her sasural where accused persons started demanding a colour T.V. and Hero Honda motorcycle and due to non fulfilment of the said demand, all accused persons subjected to her torture and cruelty in various ways. Lastly, she was ousted from her house.
It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in this case. It has further
Patna High Court Cr.Misc. No.49795 of 2014 (2) dt.30-04-2015 2/2 submitted that the complainant did not want to live with the petitioner and baseless allegation has been brought against the petitioner.
On behalf of the State, It has been submitted that the petitioner is the husband of the complainant and specific allegation has been made against him.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest/surrender in the court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Vaishali at Hajipur, in connection with Complaint Case No. 658 of 2014, subject to the conditions, as laid down u/s 438(2) Cr.P.C. with a further condition that the petitioner shall deposit an amount of Rs. 2500/- (twenty five hundred) every month in the court below and the same shall be released in favour of the complainant.
