====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 03-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Excise Case No. 52 of 2019, instituted for the offence under Section(s) 30(d) of Bihar Excise Prohibition Amendment Act, 2018, Sections 2(e), 3, 5 and 13 of Mahua Flower Act, 2006.

It is alleged in the written report that 750 kg. of Mahua flower from the Bolero vehicle and Rs.15,000/- from possession of the petitioner have been recovered. Petitioner was found sitting on the aforesaid vehicle.

Petitioner is in custody since 4.2.2019 having clean antecedent.

Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.20612 of 2019(2) dt.03-04-2019 2/2 of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Gaya, in connection with Excise Case No. 52 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
