SINHA ORAL ORDER 15-10-2015 Heard learned counsel for the petitioners and the State. Petitioners are the father, mother-in-law of the deceased. They are apprehending their arrest in connection with a case registered for the offence under Sections 304(B)/120(B) of the Indian Penal Code as their daughter-in-law suffered unnatural death within seven years of her marriage.
It is submitted on behalf of the petitioners that the deceased suffered from heart ailment and died because of the said ailment.
Aforesaid submission prima facie does not appear to be correct as from postmortem report, photocopy whereof has been presented before me, it appears that there was injury on the wrist
Patna High Court Cr.Misc. No.41406 of 2015 (2) dt.15-10-2015 2/2 of the deceased and froth was coming out of her nostril. In the circumstances, I direct the petitioners above named to surrender in the court of Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 451 of 2015 within four weeks from the date of receipt/ production of a copy of this order in the court below and apply for regular bail, which should be considered in accordance with law.
