JUSTICE SANJAY PRIYA ORAL ORDER 06-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Nagar P.S. Case No. 535 of 2018 instituted for the offence under Section 414 of the Indian Penal Code.
In the written report it is alleged that while informant along with other police official went on patrolling duty to catch the gang of vehicle thieves and was proceeding towards East from Traffic Chowk, they saw two persons on a blue colour Pulsar Motorcycle. The police chased them and ultimately they were apprehended by the police. They disclosed their names as Atul Kumar (petitioner) and Suraj Kumar. They could not produce paper of the Motorcycle in question on demand by the Police.
Patna High Court Cr.Misc. No.67219 of 2018 (2) dt.06-11-2018 2/2 Counsel for the petitioner submits that petitioner is student. He has clean antecedent. Counsel for the petitioner further submits that petitioner was only pillion rider. He has no concern with the aforesaid Motorcycle.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai, in connection with Nagar P.S. Case No. 535 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
