JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-307, 325, 379 & other minor sections of the Indian Penal Code.
The allegation against the petitioner is that he gave iron rod blows, causing injuries to the informant. The injury report of the informant has been annexed as Annexure-2 to this petition and the aforesaid injury report goes to show that the informant sustained three injuries and out of them, one injury was found on right parital region of scalp touching bone. The doctor opined the aforesaid injury to be grievous in nature. Similarly, one tooth of the injured was also found broken and the said injury was also

No doubt, one injury was found on right parital bone of the injured but according to medical report itself, the bone of the injured, was not found cut and therefore, the opinion of doctor regarding the aforesaid injury appears to be doubtful. However, the investigation against the petitioner appears to have already been completed because he is languishing in jail custody since 1607-2016. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jehanabad P.S. Case No. 385 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Jehanabad. (Hemant Kumar Srivastava, J) A.K.V./- U T
