02. In the present case, the petitioner seeks bail in connection with NDPS Case No. 21 of 2022 arising out of NCB Case No. 01 of 2022 registered for the alleged offences under Sections 20(b)(ii)(c), 25, 29 and 35 of the Narcotic Drugs & Psychotropic Substances Act.

03. As per prosecution case, official of NCB received information about transportation of huge quantity of Ganja in a truck. A trap was laid and the said truck was intercepted. The petitioner and co-accused driver were found sitting the vehicle. On search of the truck, recovery of 702 kg. of Ganja kept in plastic sacks concealed in sacks of rice was made.

04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. The petitioner is in custody since 10.01.2022 and charges have been framed against the petitioner and co-accused. However, despite framing of charge on 01.07.2024, prosecution has failed to examine all the witnesses. Learned counsel further submits that the petitioner is neither the owner nor the driver of the vehicle and has taken lift in the said vehicle and has no concern with the seized contraband. Moreover, except for confessional statement of the petitioner, there is no tangible material to show the involvement of the petitioner in the whole occurrence. The petitioner has got clean antecedent.

05. Learned counsel for the NCB vehemently opposes the submission made on behalf of the petitioner. Learned counsel further submits that the petitioner was apprehended while transporting the commercial quantity of Ganja in a truck. A counter affidavit has been filed in this case and out of five prosecution witnesses, three prosecution witnesses have been examined. Learned counsel further submits that the prosecution would produce its witnesses within a short span of time, and the trial is directed to be concluded at the earliest.

06. Having regard to the facts and circumstances and

No.23192 of 2026(6) dt.15-07-2026 3/3 submissions made on behalf of the parties and considering the recovery of the commercial quantity of Ganja from the truck from which the petitioner was apprehended, I am not inclined to enlarge the petitioner on bail. Hence, his prayer for bail is rejected.

07. The learned trial court is directed to expedite the trial and conclude the same at the earliest, considering the fact that the petitioner is custody since 10.01.2022. (Arun Kumar Jha, J) Ashish/- U T
