It has been filed in the year 1999 and four defects pointed out by the office have not been rectified. Even the records of the case have been destroyed by the High Court as is evident from the original file.
Taking note of the fact that since in the year 1999, the defects pointed out by the office have not been rectified and even the records of the case have been destroyed and learned counsel for the petitioner has no instructions in the matter and prays for further time to seek instructions, we see no reason to keep the matter pending.
Accordingly, the application is disposed of with
Patna High Court MJC No.1519 of 1999 (2) dt.22-08-2017 2/2 liberty to the petitioner to initiate fresh proceeding, in accordance with law, in case he has any grievance still subsisting in the matter.
With the aforesaid, the application stands disposed of.
