JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-12-2018 Petitioner prays for bail in connection with Jagdishpur P.S.Case No. 309 of 2018 registered for the offence punishable under Section 30(A) of Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 40 litres of liquor from the bushes near the canal and it further appears that petitioner is accused in one more case.

Submission of learned counsel for the petitioner is that nothing has been recovered from his conscious possession, rather recovery is made from the bushes near canal and further it has been submitted that though he is accused in one more case but he is on bail in that case and he is in custody since 11.9.2018.

Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.70028 of 2018(2) dt.05-12-2018 2/2 circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Bhojpur at Ara, in connection with Jagdishpur P.S.Case No. 309 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
