JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner apprehends his arrest in connection with Sono P.S. Case No. 39 of 2009, registered under Sections 302, 201 and 120-B of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. In course of investigation, the name of the petitioner and one Bhim Yadav have come in supervision note of the SDPO and Superintendent of Police in para 24 and 27 of the case diary, except the suspicion raided in the said paragraphs, nothing has been collected by the I.O of this case. The petitioner has no criminal antecedent and similarly situated co-accused Bhim Yadav has been granted anticipatory bail on 06.02.2017 by this Court vide Criminal Miscellaneous No. 716 of 2017.
Having regard to the facts and circumstances of the case,
Patna High Court Cr.Misc. No.17349 of 2017 (4) dt.17-07-2017 2/2 let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-III, Jamui in connection with Sono P.S. Case No. 39 of 2009, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
