JUSTICE SUDHIR SINGH ORAL ORDER 25-10-2016 Heard learned counsel for the petitioners and the State. The petitioners are in custody in a case registered under Sections 341, 323, 337, 302,,120(B)/34 of the Indian Penal Code and 27 of Arms Act.

The allegation against the petitioners is that they brutally assaulted the informant's party in which during course of firing, one lady, namely, Shobha Devi succumbed to fire arm injury.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 12.05.2016. Charge sheet has been submitted in this case. The petitioners have got no criminal antecedent. There is no allegation of tampering with the witnesses

Patna High Court Cr.Misc. No.35674 of 2016 (3) dt.25-10-2016 2/2 alleged against the petitioners. Specific allegation is against coaccused Mukesh Kumar for causing vital injury upon the deceased. General and omnibus allegation has been made against the petitioners. No specific injury has been attributed against the petitioners. Post mortem report also supports the allegation made in the FIR.

On behalf of the State, it is submitted that the petitioners are named in the FIR.

Considering the aforesaid facts and circumstances of the case, let, above named petitioners, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Begusarai in connection with Teghra P.S.Case No. 115 of 2016.
