JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-10-2020 Heard Mr. Ranvijay Singh, learned counsel for the petitioners, Mr. Ajay Kumar Sharma, learned counsel for the informant and Ms. Pushpa Sinha, learned APP for the State. The petitioners seek bail in connection with Dighwara P.S. Case No. 72 of 2020, dated 13.02.2020, instituted for the offences under Sections 341, 323, 376/376(D) and 34 of the Indian Penal Code, Section 4/6 of

Patna High Court CR. MISC. No.25987 of 2020(2) dt.13-10-2020 2/2 the Protection of Children from Sexual Offences Act, 2012. The petitioners are alleged to have ravished a thirteen years old girl when she had gone to attend the call of nature in the village.

It has been submitted on behalf of the petitioners that a false has been instituted against them because of the village politics. It has further been submitted that, in fact, the victim is aged nineteen to twenty years and has been leading an adulterous life.

The aforesaid grounds do not weigh with this Court.

Considering the nature of accusation against the petitioners, I am not inclined to grant bail to them, despite the fact that they are in custody since 14.03.2020. The prayer for bail of the petitioners is, accordingly, rejected.

The trial of the petitioners be expedited.
