The petitioners, who are retired employees/their dependents, have approached this Court seeking a direction upon the respondent authorities for following reliefs:- "(i) To pay due amount of gratuity and arrear of difference of pension as per recommendation of 7th pay Revision Commission Report which has been accepted by the Government w.e.f.

01.01.2016 and given monetary benefits from 01.04.2017.

(ii) To pay arrear of difference of D.A. (Dearness allowance) for the period 01.01.2022 to 30.09.2022 (iii) To pay medical allowance due Rs. 800/- (Eight Hundred) per month as per enhancement.

(iv) To pay arrear of salary as per promotion in ACP/MACP scale.

(v) To pay all the due amount with interest @ 18 % per annum compound for delay payment.

(vi) To grant other relief/reliefs for which the petitioner is entitle."

Learned Advocate for the University referring to the counter affidavit filed on behalf of the respondent nos. 3 to 5 has submitted that on receipt of the copy of the writ petition, the claim of the petitioners was duly examined and the outstanding due amount with respect to the gratuity, arrears of pension on account of revised pay scale has already been paid to the

Patna High Court CWJC No.5302 of 2023 dt.23-06-2026 3/3 petitioners. So far the claim of the petitioners for ACP/MACP is concerned, it is asserted that the same is unfounded and not applicable.

4. Learned Advocate for the petitioners submitted that he has no instruction with regard to actual payment.

Having considered the submissions advanced by learned Advocate for the respective parties and taking note of the categorical averments made in the counter affidavit filed on behalf of the respondent nos. 3 to 5, this Court finds that all the remaining outstanding dues have been paid to the petitioner and, as such, keeping the matter pending would serve no purpose.

6. Accordingly, the present writ petition stands disposed off. However, if the petitioner(s) has/have any outstanding dues, he/she is at liberty to approach before the authorities concerned for payment of the same.
