JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-12-2018 The petitioner seeks bail in connection with Barbigha P.S.Case No. 283 of 2017 registered under Sections 323, 341, 343, 384, 386, 387 and 307/34 of the Indian penal Code. Allegation against the petitioner is that is along with other accused persons demanded money for taking wine and also demanded golden Tabeez from the informant and also assaulted him by wicket. It is also alleged that accused persons dragged him to a Phokhar and tied him a tree and thereafter with intention to kill, assaulted him brutally. It further appears that apart from that, petitioner is accused in four other cases. Submission of learned counsel for the petitioner is that petitioner is a co-villager and has been falsely implicated due to village rivalry and he is in custody for more than four months. Heard learned APP also.
Patna High Court Cr.Misc. No.68595 of 2018(2) dt.03-12-2018 2/2 Having heard both sides and in view of the allegation as well as the criminal antecedents, at this stage, I am not inclined to grant bail to the petitioner. However, once, charge has been framed in this case, petitioner is at liberty to renew his prayer of bail.
