The petitioner seeks bail in connection with Ahiyapur P.S. Case No. 135 of 2020 registered under Sections 272, 273, 341 of the Indian Penal Code and Sections 30(a) and 36 of the Bihar Prohibition and Excise Act, 2016.
It is submitted by learned counsel for the petitioner that the petitioner does not have any connection with the seized vehicle in this case from where it is alleged that 394.875 litres India made foreign liquor was seized. He further contended that the petitioner was arrested by the police only because he was sitting nearby a Tea-stall and the police suspected that he was also one of the miscreants involved in the purchase and sale of prohibited liquor.
Patna High Court CR. MISC. No.19809 of 2020(2) dt.03-07-2020 2/2 Learned counsel for the State has opposed the application for grant of bail to the petitioner. Considering the facts and circumstances of the case, the plea of innocence taken by the petitioner, who is in custody since 06.02.2020 and the investigation of the case has been completed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge (Excise), Muzaffarpur in connection with Ahiyapur P.S. Case No. 135 of 2020.
