JUSTICE SANDEEP KUMAR ORAL ORDER 07-03-2022 At the very outset, learned counsel for the petitioner submits that the present application has become infructuous as the petitioner No. 1 (Binod Kumar) has been arrested and seeks permission to withdraw the same.

It is, thus, dismissed as withdrawn as having become infructuous as against petitioner No. 1.

The petitioner apprehends her arrest in connection with Goraul P.S. Case No. 528 of 2020 registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code. Petitioner No. 2 is the sister-in-law (Gotni) of the deceased and her position in the family is similar to the deceased.

Patna High Court CR. MISC. No.31539 of 2021(2) dt.07-03-2022 2/2 Considering the general and omnibus allegations and also considering her position in the family, the prayer of the petitioner No. 2 for grant of anticipatory bail is allowed. Accordingly, let the petitioner No. 2 Sumiya Devi be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Vaishali at Hajipur, in connection with Goraul P.S. Case No. 528 of 2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Sandeep Kumar, J) Saif/- U T
