This application for regular bail arises out of Taraiya P.S. Case No. 67 of 2020, disclosing offences punishable under Section 30(a) of Bihar Prohibition of Liquor Act, 2016. It is alleged in the F.I.R. that the petitioner and another co-accused were found in possession of 70 liters of country made liquor contained in two plastic gallons. Both of them were found riding in a motorcycle. On seeing the police they allegedly left the motorcycle and tried to flee away. On chase the co-accused was apprehended by the police. Learned counsel appearing on behalf of the petitioner has submitted that the petitioner has no criminal antecedent and states that, in case, the petitioner is found involved in future in

Patna High Court CR. MISC. No.19793 of 2020(2) dt.23-06-2020 2/2 similar allegation, the prosecution may apply for cancellation of his bail, if allowed by this Court.

Considering the above submission, this application is allowed.

Let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-cum-Spl. Judge, Excise, Saran at Chapra in connection with Taraiya P.S. Case No. 67 of 2020.
