2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3 . As per the prosecution case , 10 liters country made liquor was recovered near the water tank of this petitioner.

4. It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case only on the basis of suspicion . No incriminating material has been recovered from the conscious possession of petitioner and he is no way connected with the alleged occurrence . Petitioner claims clean antecedent.

5 . Learned APP for the State vehemently opposed

6. Considering the facts of the case and circumstances of the case , this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Exclusive special Excise Judge saran at Chapra in connection with Rasulpur P. S. Case No. 215 of 2024 , subject to condition as laid down under Section 482 ( 2 ) of BNSS 2023 .
