2. The present modification application has been filed for modification of the order dated 28.04.2023 passed by a Coordinate Bench of this Court in Cr. Misc. No. 4345 of 2023, to the extent that further time of four weeks' may be granted to the petitioner for surrendering before the learned court below, as the petitioner could not surrender within the period stipulated in the said order.

3. Learned counsel appearing on behalf of the petitioner submits that the petitioner could not surrender before the learned court below within the stipulated time due to unavoidable circumstances and, therefore, seeks further extension of time for surrender. It is further submitted that the

Patna High Court CR. MISC. No.24977 of 2026(2) dt.21-07-2026 2/2 petitioner is ready and willing to deposit a sum of Rs. 10,000/- (Rupees Ten Thousand only) with a charitable organization, without prejudice to his case.

4. Considering the facts and circumstances of the case and the submissions advanced on behalf of the petitioner, the present modification application is allowed.

5. Accordingly, the petitioner is granted further time of four (04) weeks from today to surrender before the learned court concerned and furnish bail bond, subject to the condition that the petitioner shall deposit a sum of Rs. 10,000/- (Rupees Ten Thousand only) with Sri Ramkrishna Sarda Ashram, AT+P.O-Rajgir, District -Nalanda at Biharsharif, Pincode803116 and shall produce the valid receipt thereof before the learned court below at the time of surrender.

6. It is made clear that the bail bond of the petitioner shall be accepted only after due verification of the genuineness and validity of the said receipt by the learned court concerned.

7. The order dated 28.04.2023 passed in Cr. Misc. No. 4345 of 2023 stands modified to the aforesaid extent. (Sandeep Kumar, J) Shishir/- U T
