The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 147, 148, 149, 341, 323, 354B, 324 and 504 of the Indian Penal Code to which section 302 of the Indian Penal Code was added subsequently.

As per the prosecution case, the ten named accused persons including the petitioner herein came variously armed and assaulted the son of the informant. It is further stated that they misbehaved with the informant's bhabhi. The accused Ranglal struck the informant's son with a lathi on his head who was taken to the hospital and was admitted to emergency ward

It is submitted by learned counsel for the petitioner that the son of the informant died and section 302 of the Indian Penal Code was added. The petitioner has been falsely implicated in the case. The allegations are general and omnibus in nature. The petitioner is in custody since 9.1.2021 and has no criminal antecedent. Chargesheet has been submitted in the case.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the FIR together with the petitioner having remained in custody for over 11 months, the petitioner is directed to be enlarged on bail in connection with Gouraul P.S. Case no. 184 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Vaishali at Hajipur.
