The present application has been filed for modification of the order dated 29.8.2016 passed in Cr. Misc. No. 37280 of 2016 whereby the petitioner being husband of the daughter of the informant was granted provisional anticipatory bail for a period of four months in a case registered for the offences punishable under sections 341,323,379,498A and 504 of IPC and sections 3 and 4 of Dowry Prohibition Act on readiness of the petitioner to keep the daughter of the informant as wife with full dignity and honour and statement to that effect has been made in paragraph 9 of the petition. The provisional bail was to be confirmed by the learned court below in three eventualities, i.e., (i) on substantial restoration of the matrimonial harmony within a
Patna High Court Cr.Misc. No.21103 of 2017 (2) dt.05-07-2017 2/2 period of one year, or (ii) if the informant's daughter fails to appear before the learned court below or (iii) if the informant's daughter deliberately gets reluctant to reconcile the issue. Learned counsel for the petitioner submits that the informant's daughter died at her parent's house, hence the issue could not be reconciled.
Considering the fact that the period of provisional anticipatory bail got lapsed on 28.12.2016 and the present modification application has been filed on 27.4.2017, this Court is not inclined to revise the earlier order. However, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within a period of six weeks from today in connection with Jay Nagar P.S. Case No. 25 of 2014, pending in the court of learned SDJM, Madhubani.
This application is disposed of with the aforesaid observation/direction.
