JUSTICE SANJAY PRIYA ORAL ORDER 27-01-2017 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in a case instituted for the offence under Sections 324, 326, 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is submitted on behalf of the petitioner that he is not named in the First Information Report. His name has come in confessional statement of co-accused during investigation. Learned A.P.P. has opposed the prayer for bail. Learned Additional Sessions Judge-1st, Saharsa has mentioned in the impugned order that in para-39 and 75 of the case diary the name of this petitioner has been disclosed on

Patna High Court Cr.Misc. No.53372 of 2016 (3) dt.27-01-2017 2/2 confessional statement of co-accused. Besides such confessional statement, there is no other material against this petitioner. Other co-accused has been granted bail by Co-ordinate Bench of this Court vide Cr. Misc. No. 39050 of 2016 dated 22.11.2016. Petitioner is in custody since 20.04.2016.

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Saharsa, in connection with Saharsa Sadar P.S. Case No. 330 of 2016, subject to the condition that both the bailors will be the close relative of the petitioner. (Sanjay Priya, J.) ravi/- U T
