2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.

3 . As per prosecution case , total 1276.44 liters of English wine was recovered from seized truck bearing registration No. UP54D-4445 and petitioner has got 2 criminal antecedent of similar nature .

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner. Petitioner is neither owner nor driver of the seized vehicle . Petitioner has got no concern with the alleged recovery and he has been made accused in this case

Patna High Court CR. MISC. No.19873 of 2025(2) dt.19-04-2025 2/2 only on suspicion .

5 . Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

6. Considering the fact that huge quantity of recovery and criminal antecedent of petitioner, prayer for anticipatory bail of the petitioner is refused.
