Petitioner seeks bail in Raj Nagar P.S. Case No.196 of 2018 instituted for the offence under Section(s) 272, 273/34 Indian Penal Code and sections 30(a), 38(2) of Bihar Prohibition and Excise Act, 2016.

Counsel for the petitioner submits that in the written report it is alleged that police got confidential information that this petitioner is keeping foreign liquor in Shishupal Plus Two High School.

It is alleged that 1345.83 litres foreign liquor has been recovered from newly constructed building of Shishupal Plus Two High School. Seizure list is part of the First Information Report, which shows that there is no recovery from personal

Counsel for the petitioner further submits that coaccused, Ramdahin Rai, has already been granted regular bail by co-ordinate Bench of this Court by order dated 21.08.2018 passed in Cr. Misc. No.51367 of 2018.

Petitioner is in custody since 13.09.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II cum Special Judge, Excise Act, Madhubani, in connection with Raj Nagar P.S. Case No.196 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
