The petitioner seeks bail in a case registered for the offence punishable under Sections 401/34 of the Indian Penal Code and Section 25(1-b)a/26,35 of the Arms Act. By order dated 19.12.2019, petitioner was granted liberty to file fresh application in accordance with law after six months. Thereafter, the present application has been filed. Patna High Court CR. MISC. No.22073 of 2020(3) dt.16-09-2020 2/2 gathered near Tineri More, police reached there. They all tried to escape to seen the police but somehow some persons were caught and they disclosed their name as Ajiz Khan @ Monu Khan (petitioner), Md. Israr @ Mister, Jagan Kumar Yadav and Tripurari Nath Shreshan. On search, one country made sixer with two live cartridges were recovered from the possession of the petitioner.
Learned counsel for the petitioner submits that there is recovery of only one country made sixer and two live cartridges from the possession of the petitioner. He submits that petitioner is languishing in judicial custody since 01.09.2019. In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Rafiganj Police Station Case No. 212 of 2019.
