2. Heard Mr. Vishwajeet Kumar Mishra, learned counsel for the petitioner and Mr. Umeshnand Pandit, learned Additional Public Prosecutor (hereinafter referred to as the 'APP') for the State.

3. The petitioner apprehends arrest in connection with Bihpur (Bhawanipur) PS Case No. 469 of 2019 dated 20.12.2019, instituted under Sections 341, 323, 354, 379, 448, 506/34 of the Indian Penal Code in which later on Section 8 of the Protection of Children from Sexual Offences Act, 2012 was added.

4. After some arguments, learned counsel for the petitioner submitted that he may be permitted to withdraw the application with liberty to surrender and pray for bail before the Court below which may be considered in view of the fact that coaccused on surrender have been enlarged on bail.

5. In view thereof, as prayed for by learned counsel for the petitioner, the application stands disposed off as withdrawn with liberty aforesaid.

6. If the petitioner surrenders and prays for bail, the same shall be considered on its own merits, in accordance with law, including the fact that other co-accused have been released on bail upon surrendering.
