JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-02-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 392 of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case, four unknown miscreants riding on two motor cycles, on the point of pistol, intercepted the informant and his two staff, assaulted them with fists and looted cash and mobile.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has come in this case during the course of investigation in the confessional statement of co-accused, Ankit Kumar. No incriminating article has been recovered from the possession of the petitioner and till date the petitioner has not been put on Test

Patna High Court CR. MISC. No.34249 of 2021(3) dt.24-02-2022 2/2 Identification Parade. Petitioner is in custody since 26.10.2020 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail and submits that during the course of investigation the name of petitioner has transpired in the confessional statement of co-accused, Ankit Kumar and motor cycle used in the crime was found to be registered in the name of this petitioner.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
